FERPA (also known as the Buckley Amendment, codified at 20 U.S.C. sec. 1232g) grants five specific rights and governs disclosure of student education records to current and former students who have reached the age of 18 OR are attending a postsecondary institution (college):
the right to inspect their own education records;
the right to prevent disclosure of their own education records;
the right to seek amendment to their own records if they are inaccurate or misleading, and in certain cases append a statement to their records;
the right to be notified of their privacy rights under FERPA; and
the right to file a complaint with the U.S. Department of Education in Washington concerning an alleged failure by the college to comply with FERPA.
Only the release of “directory information” about students without the student’s written consent is permitted. “Directory information” includes:
Student’s name, local and permanent addresses, e-mail address, telephone number, college, major, classification, current enrollment status, participation in recognized student activities, dates of attendance, degrees and awards received and dates of receipt, posting of individual student’s grades and interim class evaluations by code number or I.D. number and anticipated date of graduation based on completed hours.
